Welcome to WFFC.com, the website of the Washington Fly Fishing Club (“WFFC,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, including any pages at WFFC.com (the “Site”), and any donations, ticket purchases, or other transactions made through the Site.

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Site.

1. About WFFC

The Washington Fly Fishing Club is a membership-based organization focused on fly fishing, conservation, education, and related activities. Through WFFC.com, we may:

  • Accept donations;

  • Sell tickets to dinner meetings and other events;

  • Provide information about the club and its activities.

Nothing on this Site is intended to create any commercial relationship beyond the transactions you voluntarily enter into (e.g., donations, ticket purchases).

2. Eligibility

By using this Site, you represent and warrant that:

  1. You are at least 18 years old (or the age of majority in your jurisdiction);

  2. You have the legal capacity to enter into a binding agreement; and

  3. You will comply with these Terms and all applicable laws and regulations.

If you are using the Site on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.

3. Accounts and Information You Provide

You may be required to provide information (such as your name, email address, billing details, etc.) when making a donation, purchasing tickets, or contacting us.

You agree that:

  • All information you provide is accurate, current, and complete;

  • You will promptly update your information if it changes;

  • You will not impersonate any person or entity or misrepresent your affiliation with any person or entity.

If you create a login or account (now or in the future), you are responsible for safeguarding your login information and any activity on your account.

4. Donations

4.1 Nature of Donations

Donations made through the Site are voluntary and may be used to support the activities, operations, and mission of the Washington Fly Fishing Club. Unless explicitly stated otherwise at the time of donation:

  • Donations are generally non-refundable;

  • We are not obligated to apply donations to any particular project, event, or program.

4.2 Tax Treatment

We may be structured as a nonprofit or tax-exempt organization under applicable law. However, we do not provide tax or legal advice. Whether a donation is tax-deductible depends on your personal tax situation and current law.

You are responsible for:

  • Consulting with your tax or legal advisor;

  • Keeping any receipts or documentation we provide for your records.

5. Ticket Sales for Dinner Meetings and Events

5.1 Event Tickets

Through the Site, we may sell tickets for dinner meetings and other club events (collectively, “Events”). When purchasing tickets, you agree that:

  • Your purchase is subject to availability;

  • We reserve the right to limit the number of tickets per person, per event, or per order;

  • We may cancel or refuse any order at our discretion (for example, in case of suspected fraud or misuse).

5.2 Pricing and Payment

All prices are listed in U.S. Dollars (USD) unless otherwise stated. We may change prices at any time prior to your purchase being completed.

You authorize us (and our payment processors) to charge your selected payment method for the full amount of your order, including applicable fees or taxes. We do not store full credit card numbers on our servers; payments may be processed through third-party payment processors.

5.3 Order Confirmation

After you place an order, you may receive an email confirmation. This confirmation does not guarantee acceptance of your order; we reserve the right to cancel orders as permitted by law, in which case we will refund any amounts paid.

5.4 Cancellations, Changes, and Refunds

Our cancellation and refund policies for Events may vary by event and will be described on the event or checkout page whenever possible.

Unless explicitly stated otherwise:

  • Ticket purchases are non-refundable, except where required by law or if the Event is cancelled by WFFC;

  • If we cancel an Event, our liability is typically limited to refund of the ticket price you paid (excluding any third-party fees that are non-refundable).

If you are unable to attend an Event, you may contact us at outings@wffc.com to inquire whether transferring your ticket to another individual is allowed. We are not obligated to permit transfers.

  • Their content, policies, or practices;

  • Any loss or damage arising from your use of them.

Your use of any third-party sites or services is at your own risk and subject to the terms and conditions and privacy policies of those third parties.

To the fullest extent permitted by law:

  1. The Site, and all content, products, services, and features provided through it, are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.

  2. WFFC does not warrant that:

    • The Site will be uninterrupted, secure, or free of errors;

    • Any information on the Site is accurate, complete, or up to date at all times.

We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by law, WFFC and its officers, directors, members, volunteers, and agents will not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages;

  • Loss of profits, revenue, data, or goodwill;

arising out of or in connection with your use of the Site, your donations, your ticket purchases, attendance at any Event, or these Terms, even if advised of the possibility of such damages.

To the extent any liability is found despite the above, our total liability to you for any claim related to the Site or these Terms shall not exceed the total amount you paid to WFFC through the Site in the twelve (12) months preceding the claim.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless WFFC and its officers, directors, members, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site;

  • Your violation of these Terms;

  • Your violation of any rights of another person or entity.

13. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or relating to them, the Site, donations, ticket purchases, or Events shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws principles.

You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in King, Washington, and you consent to the personal jurisdiction and venue of such courts.

14. Changes to the Site and These Terms

We may, at any time:

  • Update, modify, or discontinue any part of the Site;

  • Change these Terms.

When we update these Terms, we will revise the “Last updated” date at the top of this page. Your continued use of the Site after any changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Site.

15. Termination

We may suspend or terminate your access to all or part of the Site, without prior notice, if we believe you have violated these Terms or applicable law, or for any other reason at our discretion.

Sections that, by their nature, should survive termination (such as intellectual property, disclaimers, limitations of liability, indemnification, and governing law) shall survive termination.

16. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy and any event-specific terms, constitute the entire agreement between you and WFFC regarding your use of the Site.

  • Severability: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

  • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.
